I voluntarily and at my own risk agree to this Disclaimer, Waiver and Limitation of Liability in sole consideration of being permitted to participate in CrossFit City Line’s (“CFCL”) nutritional program.  Accordingly, I understand, acknowledge and accept that there are dangers and risks associated with health-related programs and that, by participating in CFCL’s nutritional program and following the advice of its coaches, I am expressly assuming certain risks and factors for which I agree to indemnify and hold CFCL, its owners, principals, coaches, employees, contractors, agents, successors and assigns, landlords, attorneys and anyone related to CFCL in anyway (including CrossFit, Inc. and its affiliates), harmless and without liability for any harm to fullest extent allowed by Massachusetts law including but not limited to and/or the consequences as result of the following examples of highlighted risks: (1) CFCL is not a licensed nutritional organization; (2) its coaches are not licensed and regulated nutritionists; (3) CFCL’s advice is necessarily limited to the information about myself that I provide, including any allergy, medicinal, or other health conditions; I accept full responsibility that arises from any such allergy, medicinal, or other health condition; (4) any advice I receive is the opinion of CFCL, and, therefore, I acknowledge that I should consult with doctors or other appropriate licensed professionals when undertaking and continuing to participate in any program, including CFCL’s nutritional program, which could affect my health; (5) I must evaluate CFCL’s advice about nutritional products and supplements in light of my own specific health and fitness condition, and I understand that CFCL is not a re-seller, vendor or officially affiliated with any of the products or supplements it may recommend; (6) CFCL neither guarantees results, nor offers its services as a cure for any condition, nor provides (but rather disclaims) any express or implied warranties (including fitness for a particular purpose or merchantability) for any products it recommends or otherwise sells on its premises; and (7) I am 100% responsible at all times for evaluating the nutritional program and its effect on my health. 

In addition to and without limiting the foregoing, I agree that I cannot seek consequential or extraordinary damages resulting from any harm that I perceive as having suffered relating to the nutritional program, I waive my right to a jury trial, and agree that any legal proceeding against CFCL must be brought in the state Superior Court or state District Court (as appropriate) in Suffolk County, Massachusetts.  I have had the opportunity to consult a legal professional before signing below.

I hereby certify that I am of legal age and competent to execute this Disclaimer, Waiver and Limitation of Liability, that in doing so of my own free will and accord, voluntarily and without duress, and that I do so intending to bind myself, my executor, my heirs, and administrators or assigns to the fullest extent.  I have read and understood the foregoing, and acknowledge my consent to the terms of this Disclaimer, Waiver and Limitation of Liability
